Chapter 7 bankruptcy or "straight bankruptcy" is the most common type of bankruptcy filing. You provide information about assets, debts, recent financial transactions, income and expenses. Once that is filed, a trustee conducts a thorough review. Most cases do not involve the sale of any assets, allowing you the long-awaited chance to "start over" when your debts are formally discharged.
Unlike Chapter 7, a Chapter 13 bankruptcy or "wage earner plan" requires repayment of some debts. Not everyone passes the means test required for Chapter 7 bankruptcy, yet they still need options. Eligibility requires a regular income and debts that are within the jurisdictional limits. After a payment plan lasting 30 to 60 months, remaining debts are eligible for discharge.
